State policy trackers like Ballotpedia work one state at a time, because deepfake law is made one state at a time. Minnesota got that treatment here in November. This page gives Illinois the same rundown from our own database, where the state fills four records, all in force, and the pattern across them is unusually clean.
The four statutes
| Law | In force since | What it covers | Remedy |
|---|---|---|---|
| HB 2123 (Civil Remedies amendments) | January 1, 2024 | Nonconsensual dissemination of private sexual images, including digitized depictions | Civil action, damages, court orders |
| HB 4762 (Digital Voice and Likeness Protection Act) | August 9, 2024 | Employers and contracting parties using a performer's digital voice or likeness | Contract protections for performers |
| HB 4623 | January 1, 2025 | Obscene depictions of purported children; nonconsensual sexually explicit digitized depictions | Criminal offenses |
| HB 4875 (Right of Publicity Act amendments) | January 1, 2025 | AI-created digital replicas of a person's voice or likeness | Civil action under the Right of Publicity Act |
The pattern: consent, never labels
All four records share one flag in our database: consent is required. None of the four requires labeling or disclosure of AI content, which puts Illinois at one pole of the dataset (only 27 of 91 laws require labeling at all). Illinois regulates the act of depicting a real person without permission, across four different doors: the intimate-image door, the employer's door, the criminal door, and the publicity-rights door. A creator working in Illinois does not need a watermark. They need permission.
The contrast with Minnesota, the state this rundown format started with, is instructive. Minnesota stacks three statutes too, but one of them is an election law with a 90-day window and no labeling defense. Illinois has no election-specific deepfake statute in our records at all. Two states, two theories: Minnesota worries about the vote, Illinois worries about the person, and a national creator has to satisfy both with the same upload.
The Law Lookup holds all four records with official text attached, beside the other 87 laws in the database.
